I get emails telling me all the jobs that have been put out, sometimes it a waste but occasionally a gem like this turns up.

As part of the case we've made an application that Firstport shouldn't recharge the cost of the case as a service charge. The tribunal hasn't made a decision yet but should do so soon.

David has advised that the case against FirstPort charging service charges to Settlers Court has been won. Appeal is expected but this is a great victory to date. Well done David.
I have today emailed FirstPort requesting my service charges be returned and await a response although I can guess what it might say! I expect this will drag on for some time yet.

Hi,
First Port have issued a new Service Charge invoice to residents of Settlers Court.

Based on the decision of the First Tier tribunal, it would seem that they should not be doing this.

I have been in discussions with them, but i'm not sure their behaviour is going to change.

Just FYI guys...

- Note it would seem that Firstport have used our service charge to hire a laywer to defend charging the service charge. I'm struggling to believe that this has happened.

Did anyone else receive a letter about the Settlers Court dispute today?

This seems to suggest that since they lost the case they are putting us on notice that the rest of the leaseholders in the development may have to make up the shortfall?

I also got the Settlers Court letter I can't see why the rest of the development should stump up to pay for Firstport stupid mistakes (or is it greed).

I guess best way is to join hands with David Taylor above and have the same lawyer representing the rest of the development. I can at least rally residents at Wotton Court and Adventurers Court. Simply playing divide and rule. Service charge is not an expense account for tab. Venting frustration in the forum is not going to lead anywhere.

This is surely the best answer. I only moved in 5 years ago. I heard the residents before then were extremely upset with First Port / Consort and managed to get enough signatures to win the right to manage and remove first port as a managing agent, bu then first-port "lost" the signatures. Since then, I know David led an effort acting for settlers court to win the right to manage, which was successful. Too bad other buildings still do not have the right to manage.

Does anyone know what the outcome of the First port appeal against settlers court was? Has anyone managed to get their estate charges refunded?
